These Terms of Service ("Terms") govern your use of the Apex Automations website (apexautomations.agency) and services. By using our website, submitting a contact form, or engaging our services, you agree to these Terms. If you do not agree, please do not use our website or services.
Eligibility
You must be at least 18 years of age to use our website, submit forms, opt in to SMS messaging, or engage our services. By using our website or services, you represent and warrant that you are at least 18 years old.
Services
Apex Automations provides AI automation services for home service businesses, including but not limited to:
- AI voice agents for inbound and outbound call handling
- SMS lead nurture and follow-up automation
- CRM setup and automation (GoHighLevel, FieldRoutes)
- Workflow and pipeline automation
Services are provided on a per-project or monthly subscription basis as agreed upon between both parties in a separate service agreement.
Pricing and Payment
Service pricing will be communicated and agreed upon before work begins. Standard pricing is $250 setup fee plus $250/month per agent. Payment terms will be outlined in individual service agreements.
SMS Messaging Program
Apex Automations operates an SMS messaging program to communicate with leads and clients. By opting in to our SMS program, you agree to the following terms:
- Program description: Our SMS program sends service-related messages including appointment reminders, follow-up messages after consultations, service updates, and (with separate consent) marketing and promotional messages about AI automation services for home service businesses
- Messaging use cases: Messages may include appointment confirmations, consultation follow-ups, service delivery updates, new feature announcements, and promotional offers related to our AI automation services
- Message frequency: Message frequency varies. You may receive approximately 1 to 10 messages per month depending on your engagement and interactions with Apex Automations
- Message and data rates: Standard message and data rates may apply to messages sent and received. Check with your mobile carrier for details about your plan
- How to opt out: You may opt out of SMS messages at any time by texting STOP to any message you receive from Apex Automations. Upon receiving your STOP request, we will send a one-time confirmation message and remove you from our messaging list
- How to get help: Text HELP to any message from Apex Automations for assistance. You may also contact us at ben@apexautomations.agency or call (406) 499-1868
- Consent is not required for purchase: Opting in to receive SMS messages is not a condition of purchasing any goods or services from Apex Automations
Carrier Liability Disclaimer
Apex Automations and mobile carriers (including but not limited to T-Mobile, AT&T, Verizon, and others) are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission from your network provider. T-Mobile is not liable for delayed or undelivered messages.
Carriers are not responsible for the content of SMS messages sent by Apex Automations. Any questions or concerns about message content should be directed to Apex Automations, not your carrier.
Intellectual Property
All AI agents, automations, and systems built by Apex Automations remain our intellectual property until fully paid for. Upon full payment, clients receive a license to use the systems built for their business.
Limitation of Liability
To the fullest extent permitted by law, Apex Automations shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our website, services, or SMS messaging program. Our total liability shall not exceed the amount you have paid for services in the preceding 12 months.
Termination
Either party may terminate services with 30 days written notice. Monthly subscriptions may be cancelled at any time, effective at the end of the current billing period. You may opt out of SMS messages at any time as described above.

Changes to Terms
